Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of Openbed’s websites, applications, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. The Services
Openbed provides tools and information intended to help users discover and connect with healthcare and related service providers. Availability, eligibility, pricing, admission, and other provider information may change and must be confirmed directly with the applicable provider.
Openbed is not a healthcare provider, insurer, emergency service, or referral agency. The Services do not provide medical advice, diagnosis, or treatment. If you believe you are experiencing an emergency, call 911 or your local emergency number.
2. Eligibility and accounts
You must be legally able to enter into these Terms. If you use the Services for an organization, you represent that you have authority to bind that organization. You are responsible for providing accurate account information, safeguarding your login credentials, and promptly notifying us of suspected unauthorized access.
3. Acceptable use
You agree not to:
- Use the Services in violation of any law or another person’s rights.
- Submit information that is false, misleading, harmful, or unlawfully obtained.
- Attempt to gain unauthorized access to the Services or another user’s account.
- Interfere with the security, availability, or operation of the Services.
- Scrape, copy, reverse engineer, or use automated means to access the Services except as permitted by us or by law.
- Use the Services to distribute malware, spam, or other harmful material.
4. Provider and third-party information
The Services may display information supplied by providers, public sources, or other third parties and may link to third-party services. We do not control or endorse those third parties and cannot guarantee that their information is complete, current, or error-free. Your dealings with a provider or third party are solely between you and that party.

Our Privacy Policy explains how we collect, use, and protect personal information and is incorporated into these Terms by reference.
6. Ownership and feedback
Openbed and its licensors own the Services, including their software, design, text, graphics, and trademarks. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Services for their intended purpose. If you provide feedback, you grant us permission to use it without restriction or compensation to you.
7. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access when reasonably necessary to protect users, comply with law, maintain the Services, or address a violation of these Terms. Provisions that by their nature should survive termination will remain in effect.
8. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Openbed disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant uninterrupted or error-free operation or any particular outcome from use of the Services.
9. Limitation of liability
To the fullest extent permitted by law, Openbed and its affiliates, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from or related to the Services.
10. Changes to these Terms
We may update these Terms as the Services or applicable laws change. We will post the revised Terms and update the effective date. If a change is material, we will provide additional notice when required by law. Continued use after the revised Terms take effect means you accept them.
